Paid by AI labs for expert human data.
Labs pay Surge to design and run data projects: expert demonstrations, rubrics, preference data, RL environments and custom evaluations. A growing catalog of ready-made datasets is sold on a "pay if it works" basis. It also pitches non-lab companies on testing and tuning their models. The work is done by a large contractor network; staff run the projects. No prices or revenue split are published.

Annotators' lawyers say they are misclassified.
Clarkson Law Firm, May 2025; LA Times via AOL, May 21, 2025; Forbes, Sep 2025A proposed class action filed May 20, 2025 in San Francisco Superior Court says Surge treats data annotators as contractors while controlling their work, and requires unpaid training. Plaintiff's counsel called it "wage theft on a massive scale." Chen said the suit is without merit.
These are allegations, not findings. No ruling or settlement has been reported. A loss could raise the cost of its contractor model.

A new Labor Counsel role.
Surge Labor Counsel posting, Oct 29, 2026Posted Oct 29, 2026, as a new role. It advises on worker classification for employees and contractors and manages claims and agency matters.
Shows the contractor question is now a standing legal function, not a one-off. It also suggests the company is building out its back office.

Surge Controller posting, Aug 31, 2026A posting from Aug 31, 2026 seeks Surge's first dedicated internal Controller to own GAAP books, revenue recognition for AI lab contracts and contractor payments. Payroll runs through a PEO.
A $1B+ revenue company only now building an accounting team is unusual. Audit-ready books are a step any IPO or big raise would need; nothing has been announced.

Forbes says Surge sells to China's Tencent.
Forbes (Anna Tong), Mexico edition, Aug 5, 2026Forbes reported in Aug 2026 that a Tencent data executive wrote that Tencent depends on Surge, and that Chen traveled to China to meet lab executives. Surge said it does not disclose clients. Forbes lists the US Army and Air Force as customers too.
Reported, not confirmed by Surge. Serving Chinese labs and US defense at once could draw political or export scrutiny.

Forbes (Australia edition), Sep 17, 2025; Surge workforce page, Nov 3, 2026An OpenAI spokesperson told Forbes in Sep 2025 that OpenAI no longer works with Surge. Surge's workforce page still names OpenAI among partners.

Forbes says DataAnnotation is its contractor arm.
Forbes (Australia edition), Sep 17, 2025; DataAnnotation FAQ, Nov 3, 2026Forbes describes DataAnnotation Tech as a wholly owned affiliate that hires Surge's annotators. DataAnnotation's own site does not name Surge; it says it connects over 1 million contractors and lists $25 to $150+ an hour.
Staff jobs (34 open) and DataAnnotation gig work are different deals. The gig roles are contract work, with no salary, benefits or equity.
